    If you got hurt in Washington because someone else was careless, you might be able to file a personal injury claim. This could be after a car accident, a fall on unsafe property, or using a dangerous product.

    How long do you have to file a claim?

    In most cases, you have three years from the day you were hurt to file a lawsuit in court. This rule covers things like car accidents, slip and falls, dog bites, and even wrongful death cases. If you miss this deadline, you usually can’t sue. However, some injuries have different deadlines. For intentional injuries, like assault or defamation, you have two years. In cases of medical malpractice, you have three years from when the incident happened or one year from when you discovered it, whichever gives you more time. For dangerous products, you usually have three years, but if you don’t discover the injury right away, the clock starts when you should have found out. Still, you must sue within 12 years of when the product was first used.

    Can the deadline ever be extended?

    In some situations, the deadline can be extended. If the person you’re suing leaves Washington or hides, the clock may pause. If you didn’t know about your injury and couldn’t have found out in time, the clock may start later. This is called the discovery rule. If the injured person is a minor, in prison before sentencing, or can’t understand the legal process, the clock pauses until that changes.

    What if you’re suing the government?

    If you want to sue the government in Washington, you must first file a special claim form and wait 60 days before suing in court. To sue a local government, like a city or county, you must also file a claim form with that government and wait 60 days.

    What if you were partly at fault?

    Washington follows a rule called pure comparative negligence, which means that if you were partly to blame for your injury, your compensation will be reduced by your percentage of fault. For example, if a store is 80 percent to blame for your fall and you are 20 percent to blame, you get 80 percent of the money. So if your total damages are $60 thousand, you get $48 thousand. Even if you are 99 percent to blame, you can still collect one percent of your damages.

    What about car accidents?

    Washington uses a fault-based system. If another driver causes the crash, you can sue them for damages. Drivers must have insurance to pay for any harm they cause: $25 thousand for injury to one person, $50 thousand for injury to two or more people, and $10 thousand for property damage.

    Are there limits on personal injury payouts?

    No. Washington does not put a cap on personal injury damages. But punitive damages—money meant to punish someone for extreme behavior—are not allowed.

    What if a dog bites someone?

    In Washington, dog owners are always responsible if their dog bites someone. It doesn’t matter if the dog was never violent before. The rule applies if the person was on public property or had a legal reason to be on private property.
